The Bombay High Court, Aurangabad Bench, has quashed criminal proceedings against Tushar Sampat Mane and his family members in a case filed under Sections 498-A, 323, 504, 506, read with Section 34 of the IPC. The case arose from an FIR lodged by Tushar’s wife, Bhagyashree, alleging physical and mental harassment, suppression of medical history, and a demand of ₹15 lakh for purchasing a flat.
Justice Smt. Vibha Kankanwadi and Justice Sanjay A. Deshmukh observed that the couple married on 24 March 2022 and lived together for about one year and three months. The informant claimed she later discovered her husband’s mental health treatment, which was allegedly concealed before marriage. However, the court noted that pre-marriage chats, part of the chargesheet, showed she was aware of his medical condition.

The court further held that the allegations against the mother-in-law and sisters-in-law were omnibus and lacked independent witness support.
"Making annoying statements or small domestic disagreements cannot be considered grave cruelty under Section 498-A IPC," the bench stated.

The judges highlighted that the FIR contained exaggerations and lacked evidence from neighbours or neutral parties. Since the demands and allegations did not meet the legal threshold of cruelty, continuing the trial would amount to an abuse of the legal process.
Accordingly, the court allowed the application under Section 482 CrPC and quashed the proceedings in Regular Criminal Case No. 290/2024 against all applicants.
