Himachal Pradesh HC Intervenes to Protect Young Couple from Harassment

The Himachal Pradesh High Court has directed the Superintendent of Police, Sirmaur, and the Station House Officer, Nahan, to take appropriate action to protect the life and liberty of a young couple who approached the court citing threats from private individuals.

The petition, filed under Article 226 of the Constitution of India, sought a writ of mandamus directing the police authorities to safeguard the couple and prevent harassment by respondents numbered 4 to 9. The petitioners also requested that the police not allow any interference in their personal lives.

According to court records, the petitioners belong to the Muslim community and got married on 30 July 2025 in Khizrabad, Yamunanagar, Haryana, following Islamic rites and out of their own free will. Petitioner No. 1, a 20-year-old barber, provided his Aadhaar card showing his date of birth as 19 August 2004, along with his marriage certificate and shop rent agreement. Petitioner No. 2 is 17 years old, with an Aadhaar card indicating her date of birth as 1 July 2008.

The petition cited the Principles of Mohammedan Law, which recognize the age of puberty for Muslim females as 15 years. Under these principles, if a girl above the age of 15 marries a person of her choice with her consent, such a marriage is not considered void. The couple claimed they married willingly and without coercion.

They also submitted a written representation dated 5 August 2025 to the authorities, outlining the threats they faced.

While hearing the matter, the Bench of Chief Justice G.S. Sandhawalia and Justice Ranjan Sharma referred to the Supreme Court’s landmark judgment in Lata Singh v. State of U.P. (2006) 5 SCC 475, which upholds the right of adults to marry a person of their choice without interference.

"A case is made out for the petitioners for issuance of directions to the respondents to look into the representation and take appropriate action, if so required," the court stated.

The court directed the authorities to examine the couple’s complaint and act as necessary to ensure their protection. The petition was accordingly disposed of, with all pending applications closed.
