The Calcutta High Court has stepped in to address delays in the investigation of the Sandeshkhali gang rape case, directing the formation of a Special Investigation Team (SIT) to ensure a thorough and timely probe. The case, which allegedly involves politically influential individuals, has drawn significant attention due to procedural lapses and the gravity of the allegations.
During a hearing on January 27, 2025, Justice Tirthankar Ghosh voiced concerns over the sluggish progress in Sandeshkhali Police Station Case No. 238/2024, registered on May 16, 2024. The court’s dissatisfaction arose after Advocate General Kishore Datta submitted a list of officers to oversee the investigation. Highlighting the need for urgency, Justice Ghosh mandated the creation of an SIT comprising:

- Mr. Rahul Mishra, IPS, SDPO of Baduria (Basirhat Police District), and
- Mr. Bireswar Chatterjee, Assistant Commissioner of Police, Homicide Section, Detective Department, Lalbazar.
The SIT has been granted autonomy to select inspectors and sub-inspectors to assist in the investigation.
“Already there has been delay in the case,” the court observed, directing the immediate transfer of case records to the newly formed SIT. The team has been instructed to:
- Submit monthly progress reports to the ACJM, Basirhat,
- Expedite evidence collection, including forensic analysis of samples,
- Ensure meticulous coordination between district authorities and departments.
Justice Ghosh emphasized: “The investigation team must apply their mind to ensure the case reaches its logical conclusion effectively.”
The court clarified that its intervention does not reflect a judgment on the case’s merits but aims to streamline the process. Additional safeguards include:
- Prior notice to the ACJM if the district administration withdraws security provided to the petitioner,
- Urgent certified copies of the order to be made available to involved parties.
The writ petition (WPA 560 of 2025) was formally disposed of with no order on costs.
Context of the Case
The allegations stem from an incident in Sandeshkhali, a region in West Bengal’s North 24 Parganas district. Delays in evidence collection and logistical challenges reportedly hindered progress, prompting judicial intervention. The SIT’s role now includes overcoming these hurdles through structured teamwork and forensic collaboration.
By constituting an SIT led by senior officers, the Calcutta High Court underscores the need for accountability and efficiency in sensitive criminal investigations. The move signals a push for transparency, particularly in cases involving high-profile accused. Stakeholders await the SIT’s first progress report, which could set a precedent for handling similar cases in the future.
