The Delhi High Court on Thursday (16 July) directed the Central Government and the Government of NCT of Delhi to ensure that climate activist Sonam Wangchuk's health is monitored every day by government doctors while he continues his indefinite hunger strike at Jantar Mantar. The Court also directed that immediate medical intervention be provided whenever doctors consider it necessary to protect his life.
The order came after the Centre assured the Court that Wangchuk's health was already being checked regularly and that all required medical assistance would be provided based on medical advice.
Background of the Case
The Public Interest Litigation (PIL) was filed by Advocate Rakesh Kumar Saini, who sought urgent directions for medical intervention, stating that Wangchuk's health had deteriorated during his ongoing hunger strike.
The petition urged the Court to direct the authorities to ensure proper medical care and take all necessary steps to safeguard Wangchuk's life. It was submitted that he had been on an indefinite fast since June 28 while participating in a protest at Jantar Mantar.
Court's Observations
A Division Bench comprising Chief Justice Devendra Kumar Upadhyaya and Justice Tejas Karia emphasized that protecting human life remains a primary concern.
Recording the assurance given by Solicitor General Tushar Mehta, the Bench observed:
"Life of any citizen is precious and all efforts ought to be made by the government authorities to save the same."
The Court further noted that the Centre had informed it that Wangchuk's health would continue to be examined daily by government doctors and that any medical intervention required on the basis of their assessment would be carried out without delay.
The Bench appreciated the stand taken by the Centre and observed that Wangchuk's clinical condition should continue to be monitored regularly.
Court's Decision
Disposing of the PIL, the Delhi High Court directed that Sonam Wangchuk's health be clinically monitored on a daily basis by government doctors and experts.
It further ordered that all necessary medical assistance and intervention be provided immediately if doctors find it necessary in view of his medical condition.
