The Delhi High Court has dismissed a plea by Dhananjay Nivrutti Lokhande challenging his arrest in the NEET-UG paper leak case, holding that the petition had no merit and amounted to an abuse of the legal process.
Background of the Case
Lokhande, who was arrested on May 13, had approached the High Court after the trial court rejected his request for a copy of the arrest memo. He argued that the absence of such a memo made his arrest illegal.
He also claimed that the chargesheet contained only a two-page Personal Search Memo relating to his arrest and did not show the grounds, date, time or place of arrest.
The CBI opposed the plea, stating that the grounds of arrest had been communicated to Lokhande and that the information was also conveyed over the telephone.
A Division Bench comprising Justice Navin Chawla and Justice Ravinder Dudeja rejected the challenge.
“We find the present petition to be an abuse of the process of law. This is absolutely meritless. Accordingly, we dismiss the same with a cost of ₹25,000.”
The Court directed that the ₹25,000 cost be deposited with the Advocates Welfare Fund.
