Background of the Case
The FIR was initially registered by the complainant under Section 498A (cruelty by husband), 406 (criminal breach of trust), and 34 (common intention) of the IPC. However, both parties later decided to settle their differences and resume their marital relationship.
“I have again spoken with petitioner no. 1 and respondent no. 2 present in court and it is stated by them that now, having compromised all their disputes, they are living together happily and also have a daughter currently aged 04 years,”— Justice Girish Kathpalia
The judge further noted that the complainant, respondent no. 2, did not wish to pursue the prosecution against the petitioners any longer.

The Hon’ble Justice Girish Kathpalia, after interacting with both parties and verifying their current status, observed that forcing the parties to go through trial would not serve any useful purpose and could potentially disturb their reconciled relationship.
“Having spoken with the parties, I am satisfied that it would be in the interest of justice not to push them through trial.”
— Justice Girish Kathpalia
Considering the mutual settlement and the well-being of the couple's four-year-old daughter, the court decided to allow the petition.
