Supreme Court Grants Anticipatory Bail to Meera Devi in NDPS Case

In a recent decision, the Supreme Court of India disposed of the Special Leave Petition (Crl.) No. 3631 of 2025 filed by Meera Devi, who was seeking protection from arrest in an NDPS (Narcotic Drugs and Psychotropic Substances Act, 1985) case.

The case stems from FIR No. 171 of 2024, dated 12th June 2024, registered at Kochas Police Station, Rohtas District, Bihar, for offences under Sections 8(c), 20(b)(ii)(B), and 29 of the NDPS Act. The petitioner, Meera Devi, had approached the Court fearing arrest, especially since her husband had already been taken into custody in the same case.

"We deem it appropriate to confirm the order of interim protection and release the petitioner on anticipatory bail," the Court stated.

Earlier on 20th March 2025, the Court had granted interim relief by directing that no coercive steps be taken against Meera Devi, subject to her cooperation with the investigation.

The Supreme Court bench comprising Justice J.K. Maheshwari and Justice Vijay Bishnoi passed the following key directions:

  • Anticipatory Bail Granted:
    Meera Devi shall be released on bail in the event of arrest, upon furnishing suitable bail bonds and sureties. The Station House Officer may impose appropriate terms and conditions.
  • Cooperation in Investigation:
    The petitioner is directed to join the investigation as and when required and follow all conditions under Section 438(2) CrPC.
  • Trial Obligations:
    She must cooperate during the trial after the chargesheet is filed.

"Any violation by the petitioner may lead to appropriate action by the trial court," the bench warned.

With these directions, the Special Leave Petition was disposed of. Any pending applications related to the case were also deemed resolved.
