The Delhi High Court on September 10, sought a response from the makers of the proposed film Kala Hiran: The Battle for Legacy on actor Salman Khan’s plea seeking to restrain its release.
Justice Jyoti Singh was hearing Khan’s commercial suit against producer Amit Jani and others. The actor has raised objections over the film’s alleged portrayal of him and has sought interim protection against its release, streaming and promotion.
Background of the Case
Khan has alleged that Kala Hiran is connected with the 1998 blackbuck case and uses a character resembling him. He has also objected to promotional material which, according to him, depicts a character associated with the actor in connection with the blackbuck incident.
The actor is seeking removal of the film’s promotional material, an apology and damages exceeding ₹2 crore, besides an order preventing its release.
During Thursday’s hearing, Khan’s counsel, Senior Advocate Ravi Prakash, submitted that the makers had indicated the film could be released in September.
The producer’s counsel told the Court that the film was not currently in a releasable form because its contents had not yet been certified by the Central Board of Film Certification (CBFC).
The Court recorded the statement.
“Counsel appears for Defendant No. 1 and on instructions states that the impugned movie at this stage is not in a releasable state as its content is yet to be certified by Censor Board.”
Khan’s counsel also pointed out that certification may not be required for an OTT release. The Court took the submission on record.
The High Court directed the producer to file a reply within two weeks, with Khan to file a rejoinder before the next hearing.
The matter has been listed for September 30.
