The Kerala High Court today disposed of the petition filed by Advocate Beylin Das, who was earlier barred from practicing by the Kerala Bar Council over an alleged assault on a woman advocate.
Justice N Nagaresh disposed of the plea after it was informed that the Bar Council had reconsidered the petitioner’s representation.
During the hearing, the senior counsel appearing for the Bar Council of Kerala informed the Court that in the meeting held on July 11, 2025, the Council had reviewed the petitioner’s request and decided to lift the restriction on his legal practice, which was originally imposed through an order dated May 15, 2025 — subject to four conditions.
"The petitioner’s counsel submitted that the petitioner is currently facing a criminal case and the trial proceedings are expected to commence soon. He argued that being required to testify before the Bar Council at this stage might prejudice his defence in the criminal trial."
The Court acknowledged this concern and found merit in the argument that testifying before the Bar Council could affect the petitioner’s legal defence. However, the senior counsel for the Bar Council emphasized that, as per established legal precedent, disciplinary proceedings and criminal trials can proceed simultaneously.
"The Court stated that the petitioner is free to raise his concerns before the Bar Council. It expressed confidence that the Bar Council will consider such representations before proceeding further."
