The Kerala High Court has quashed the criminal proceedings against businessman Boby Chemmanur after recording that the dispute with the complainant, a Malayalam actress, had been amicably settled. The Court accepted the settlement after its authenticity was verified by the prosecution.
Background
The case arose from allegations linked to an inauguration event at a jewellery showroom in Kannur. Based on the actress's complaint, police registered a case under Section 75 of the Bharatiya Nyaya Sanhita and Section 67 of the Information Technology Act. The complaint also referred to alleged remarks made on social media after the event.
Chemmanur was arrested on January 8, 2025, and was later granted bail by the High Court on January 14, 2025.
Justice Jobin Sebastian had earlier stayed further proceedings after being informed that both sides had resolved the dispute. The complainant submitted an affidavit confirming the settlement, and the Public Prosecutor verified its genuineness as directed by the Court.
“The dispute has been amicably settled,” the Court noted while considering the plea to quash the proceedings.
Allowing the petition, the Kerala High Court quashed the pending criminal proceedings against Boby Chemmanur in view of the verified settlement between the parties.
