Madras High Court Dismisses Plea Seeking UN Reforms for India’s ‘Due Place’

The Madras High Court has rejected a petition urging the Ministry of External Affairs to push for reforms in the United Nations Organisation (UNO) to secure what was described as India’s ‘due place’ in the international forum and to promote world peace.

A division bench comprising Justice SM Subramaniam and Justice AD Maria Clete dismissed the petition, calling the relief sought “misconceived” and beyond the legal jurisdiction of the high court.

The petitioner, Abimani, had filed the plea seeking a writ of mandamus directing the Ministry of External Affairs to actively consider advocating for a definite reformation of the UNO, with the aim of achieving India’s rightful position and ensuring stable global peace.

Apart from the Ministry of External Affairs, the plea also listed the Principal Secretary to the Prime Minister, the Ministry of Home Affairs, the Ministry of Law and Justice, and the Law Commission of India as respondents.

The petitioner, however, did not appear before the court at the time of hearing. The bench, hearing the submissions of Senior Standing Counsel for the Central Government, V Malaiyendran, proceeded to reject the plea.

“The relief sought for is absolutely misconceived and falling beyond the realm of the jurisdiction of the high court. Thus, the writ petition stands dismissed. No costs,” stated the bench while passing the order.
