In a significant move addressing road safety and licensing practices, the High Court of Madhya Pradesh has taken up a public interest issue concerning how driving licences are issued across the state. The court has issued notices to multiple authorities, seeking clarity on whether proper procedures and safety standards are being followed.

Background of the Case

The matter arose from a writ petition filed by Ashish Shivhare, who appeared in person before the court. The petitioner raised several concerns about irregularities in the issuance of driving licences and broader road safety measures.

While multiple issues were highlighted, the court narrowed its focus to two key areas how driving licences are granted and what steps are being taken to ensure road safety by concerned departments.

A bench led by Chief Justice Sanjeev Sachdeva and Justice Vinay Saraf observed that the core issue lies in the process of issuing driving licences and the enforcement of road safety norms.

“The petition really raises issues with regard to the road safety measures and the issuance of Driving Licence,” the bench noted, adding that addressing these aspects would also cover the other concerns raised.

The court further emphasized the need to examine whether licences are being issued by properly trained personnel and whether applicants are complying with driving norms before being granted licences.

The court issued notice to multiple respondents, including state authorities and concerned departments, specifically on:

  • The process of issuing driving licences
  • Measures taken by transport authorities to ensure proper training and compliance
  • Road safety mechanisms implemented by various agencies

Government Advocate Anubhav Jain accepted notice on behalf of several state respondents, while Deputy Solicitor General S.M. Guru appeared for the Union respondent. Notice was also directed to be issued to another respondent.

Considering that the petitioner was arguing the case in person, the court appointed Advocate Arihant Tiwari as Amicus Curiae to assist in the matter.

“The Court deems it appropriate to appoint an Amicus Curiae to assist,” the order recorded, ensuring proper legal assistance in examining the broader issues involved.

The High Court issued notices limited to the issues of driving licence issuance and road safety measures. The matter has been listed for further hearing on April 27, 2026.
