The Madhya Pradesh High Court at Jabalpur on June 8, 2026, allowed the bail application of one Chhabilal Uaike, who had been lodged in judicial custody since March 2025 in connection with a case registered at Police Station Roopjhar, District Balaghat.

Background of the Case

The case, Crime No. 08/2025, was registered against the applicant under several provisions of the IPC as well as Sections 66E and 67A of the Information Technology Act. The first bail application was filed before Justice Rajendra Kumar Vani under Section 439 of the CrPC, read with Section 483 of the BNSS.

Advocate D.S. Parihar, appearing for the applicant, placed key facts on record. He told the court that the FSL report had returned negative, and as a result, no DNA examination was carried out by the prosecution. He further pointed out that the prosecutrix - examined as PW-1 - while supporting the prosecution in her examination-in-chief, had during cross-examination openly admitted she was in a love relationship with the applicant.

The prosecution's photographic material also came under scrutiny, as the face of the woman in those images was reportedly not identifiable. Additionally, in paragraph 7 of her deposition, the prosecutrix admitted that the applicant had not forcibly entered her residence. The State opposed the bail and sought its rejection.

After hearing both sides and going through the case diary, Justice Vani noted the prolonged period of incarceration and the weaknesses appearing on record in the prosecution's case. The bench observed that considering the facts and circumstances, the court was inclined to grant relief to the applicant.

The application was allowed. The court directed that Chhabilal Uaike be released on a personal bond of Rs. 50,000 with one surety of the same amount, subject to standard conditions including cooperating with the trial, not tampering with witnesses, not leaving India without permission, and not seeking unnecessary adjournments.
