Rahul Gandhi Moves Supreme Court Against Allahabad HC Orders Directing CBI, ED to Verify Disproportionate Assets Allegations

Leader of Opposition Rahul Gandhi has approached the Supreme Court against a series of orders passed by the Allahabad High Court in proceedings concerning allegations of assets disproportionate to known sources of income. The challenge will be considered by the Supreme Court on August 17.

Background of the Case

The proceedings before the Allahabad High Court stem from a complaint filed by BJP worker S. Vignesh Shishir. The complaint sought verification of allegations concerning Gandhi’s assets.

In May, the Allahabad High Court directed the Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED) to examine the allegations in accordance with law. The agencies were also required to inform the Court about the progress of the steps taken on the complaint.

The High Court did not itself record a finding on the allegations. Instead, it directed the agencies to examine the claims and take such steps as may be permissible under law.

The matter came up again before the High Court on July 20. A Bench comprising Justice Brij Raj Singh and Justice Rajesh Singh Chauhan expressed dissatisfaction with the response submitted by the CBI.

The Bench observed that the CBI's affidavit did not appear to address the earlier directions adequately. It remarked,

“Even we are unable to understand about the progress of the investigation done by the CBI.”

The Court noted that the ED had taken the required steps. It further indicated that the agency could proceed in accordance with law if its inquiry disclosed material warranting further action.

The High Court directed that the proceedings continue before the same Bench and fixed the matter for August 20.

Gandhi has now challenged the High Court's directions before the Supreme Court. Along with the main challenge, he has filed a separate transfer petition seeking transfer of the proceedings from the Allahabad High Court to the Delhi High Court.

The Supreme Court Bench comprising Chief Justice of India Surya Kant, Justice Joymalya Bagchi and Justice V. Mohana is scheduled to consider the petitions on August 17.

The Supreme Court has not yet passed a final order on Gandhi's challenge. The matter remains pending and is listed for consideration on August 17, 2026.
