The Rajasthan High Court has directed the Bar Council of Rajasthan to dispose of all pending applications for enrolment as advocates by September 9, 2026. The direction came in a writ petition concerning delay in processing an advocate enrolment application.

Justice Shubha Mehta pronounced the judgment on September 3, 2026, in Surendra Khinchi v. The Bar Council of Rajasthan & Ors. The arguments in the matter had concluded on July 27, 2026.

Background Of The Case

The petitioner, a 2025 law graduate of Dr. Bhimrao Ambedkar Law University, Jaipur, had submitted an application with the required documents and fee for enrolment with the Bar Council of Rajasthan. He also sent a separate representation through email. However, the application remained pending amid the Bar Council elections and administrative issues.

During the hearing, it was informed that no committee was then functioning to process enrolment applications. An earlier committee constituted on February 24, 2026, had been cancelled on March 12, 2026. As a result, several applicants were facing delays in obtaining enrolment.

Court's Observation

The High Court noted that the Bar Council elections had since been completed and their results had been declared. It also took note of the fact that several candidates had similar enrolment applications pending.

"In the present circumstances, since the election process of the Bar Council of Rajasthan has been completed and the results have also been declared, it appears appropriate to direct disposal of the application submitted by the petitioner for enrolment as an advocate. It has also been brought to the notice of this Court that applications of several other candidates are pending in the same manner."

Decision

Allowing the petition, the High Court directed the Bar Council of Rajasthan to dispose of all applications pending for enrolment as advocates as on the date of the order, in accordance with the prescribed procedure, by September 9, 2026, and to inform the concerned applicants. The petition and connected applications were accordingly disposed of.

The order is also consistent with a contemporaneous report on the judgment.
