Rajasthan HC Grants Final Bail Extension to Asaram Bapu Till August 12 in 2013 Rape Case

The Rajasthan High Court, on July 8, 2025, extended the interim bail granted to Asaram Bapu—convicted in a 2013 rape case—until August 12, 2025. This decision was made by the division bench comprising Justice Dinesh Mehta and Justice Vinit Kumar Mathur, following the Gujarat High Court’s July 3 order in a similar matter.

Asaram Bapu, aged 86, is serving a life sentence for multiple convictions, including a separate 2013 rape case in Gujarat. His current interim bail has been extended on medical grounds, with the Rajasthan High Court clearly stating that this is likely to be the last extension.

“Following the observations and decision dated 03.07.2025, the application seeking extension of temporary bail granted by this Court on 14.01.2025 is allowed. The period of temporary bail of the applicant is extended up to 12.08.2025, while observing that no further indulgence shall be granted to the applicant,”

During the hearing, the petitioner’s counsel submitted that the Gujarat High Court had partially allowed a similar application and extended temporary bail for one month. Referring to that judgment, the counsel requested the Rajasthan High Court for a similar period of extension.

"The applicant would be satisfied if a month's extension is granted to him, subject of course to his right to challenge the Gujarat High Court's July 3, 2025 order,"

Previously, the Rajasthan High Court had extended Asaram’s interim bail multiple times. Most recently, on July 1, the bail was extended till July 9. Earlier, on April 7, an extension was granted till July 1, citing his deteriorating medical condition.

In its April 7 order, the Rajasthan High Court had noted that:

“So far as medical condition of the applicant is concerned, the High Court of Gujarat has considered the same deeply and we do not wish to undertake the same exercise afresh and take a view other than what has been taken by the High Court of Gujarat.”

The Gujarat High Court, in its 03.07.2025 order, also made it clear that:

“No further prayer for extension of temporary bail will be entertained on medical grounds.”

The Rajasthan High Court’s current order is in line with that position, and indicates judicial restraint on continued extensions based solely on health conditions.
