The Supreme Court on Monday requested the Calcutta High Court to decide within one week the pending application filed by Trinamool Congress MP Abhishek Banerjee seeking permission to travel abroad for specialised eye treatment. The Court did not examine the merits of the request and left the issue to the High Court.
Background
Abhishek Banerjee challenged the Calcutta High Court's refusal to grant immediate permission for overseas medical treatment. The High Court had earlier directed him to first undergo an assessment at Kolkata's SSKM Hospital to determine whether the required treatment could be provided in India.
The travel restriction forms part of an interim protection order passed in criminal proceedings arising from cases registered after the West Bengal Assembly elections. Under that order, Banerjee cannot leave the country without prior permission of the High Court.
A Bench comprising Chief Justice of India Surya Kant, Justice Joymalya Bagchi and Justice V. Mohana heard the matter.
Senior Advocate Gopal Sankaranarayanan, appearing for Banerjee, submitted that the application only sought permission for medical travel and pointed out that similar permission had been granted on earlier occasions.
Recording the submissions, the Bench observed,
"We request the High Court to decide the case within a week."
Without expressing any opinion on the merits of the request, the Supreme Court asked the Calcutta High Court to consider and decide Banerjee's pending application for permission to travel abroad for eye treatment within one week.
