The Supreme Court has taken exception to the Andhra Pradesh High Court listing a criminal revision petition under the caption “For Dismissal” even though the matter had already been heard on merits.
A Bench of Justices Ujjal Bhuyan and Atul S. Chandurkar observed that such a listing could indicate that the decision had already been taken before the order was formally pronounced.
Background
The matter before the Supreme Court arose from a final judgment dated December 4, 2025, passed by the Andhra Pradesh High Court in Criminal Revision Case No. 2491 of 2015.
The Supreme Court order records that the criminal revision had been heard on merits on November 21, 2025. However, the High Court subsequently listed the case under the caption “For Dismissal” and thereafter dismissed the revision.
The petitioner, K Ravi, challenged the High Court proceedings before the Supreme Court through a Special Leave Petition (Criminal), Diary No. 40946/2026.
The Bench expressed concern over the manner in which the matter was listed, particularly because it was a criminal case.
“Listing of a case under such a caption itself indicates that a decision has already been taken before actual pronouncement of the order. This is not proper, more particularly in criminal matters.”
The Court recorded that the revision had been heard on merits before it was listed under the “For Dismissal” caption.
The Supreme Court condoned the delay in filing the petition and issued notice to the State of Andhra Pradesh on the question of reconsideration/remand of the matter.
The notice was made returnable on October 29, 2026.
