Section 13: Change in the constitution of Educational Agency or transfer of Educational Agency
Change in the constitution of Educational Agency or transfer of Educational Agency.
(1)
(a)
Whenever there is any change in the constitution of an educational agency or amendment to the bye laws or memorandum of association of the educational agency shall submit all relevant documents relating to all such changes or amendments to the competent authority within fifteen days therefrom;(b)
Whenever an educational agency of any private school proposes to transfer the management of the school to another educational agency having similar objectives, such educational agency should apply to the competent authority for necessary approval;(c)
An application under clause (b) shall be in such form accompanied by such documents as may be prescribed.(2)
On receipt of an application under clause (b) of sub-section (1), the competent authority shall, after making such inquiry, as it deems fit, and if it is satisfied that the educational agency of the transferee school will maintain and manage the private school so transferred in accordance with the provisions of this Act, or the rules or the directions issued thereunder, approve the transfer, subject to such conditions as it may impose and communicate its decision to the applicant within a period of one month from the date of receipt of such application.Disclaimer: This section is reproduced for general informational and reference purposes only.
