What is Agreement Format?

An Agreement is a mutual understanding between two or more competent parties recorded in writing, setting out the terms of their bargain. Under Section 2(e) of the Indian Contract Act, 1872, an agreement is defined as "every promise and every set of promises forming the consideration for each other." When an agreement is enforceable by law, it becomes a contract as defined in Section 2(h) of the Act.

For an agreement to be a valid and enforceable contract under Section 10 of the Indian Contract Act, 1872, it must satisfy these essentials: free consent of competent parties (Sections 11 and 14), lawful consideration and object (Sections 23 and 25), and not be expressly declared void.

Special transaction-based agreements are governed by their own statutes — sale of immovable property under the Transfer of Property Act, 1882 and Registration Act, 1908; sale of goods under the Sale of Goods Act, 1930; partnership under the Indian Partnership Act, 1932; arbitration under the Arbitration and Conciliation Act, 1996; and flat purchase under RERA, 2016 and state apartment ownership laws.

A properly executed agreement is admissible as documentary evidence under the Bharatiya Sakshya Adhiniyam, 2023 (which replaced the Indian Evidence Act, 1872). Any person of sound mind, of majority age, and not disqualified by law may execute an agreement.
