The Delhi High Court has refused regular bail to a woman accused in a dowry death case involving the suicide of a young bride within eight months of marriage. The Court observed that allegations of continuous harassment and dowry demands, coupled with an audio recording made shortly before the woman’s death, required serious consideration at the bail stage.

Background of the Case

The case arose from FIR No. 573/2024 registered at Vivek Vihar Police Station in Delhi under provisions of the Bharatiya Nyaya Sanhita relating to dowry death, cruelty, and common intention. According to the prosecution, the deceased woman died by suicide on November 29, 2024, after allegedly facing repeated harassment from her husband and in-laws over a demand for ₹3 lakh.

The complainant, who is the deceased woman’s father, alleged that despite spending substantially on the marriage, his daughter continued to face physical and mental harassment in her matrimonial home. Statements recorded during the investigation claimed that the deceased had informed her family members several times about the alleged torture and dowry-related pressure.

Investigators also seized an audio recording in which the deceased was allegedly heard crying and narrating an incident involving abuse and threats by her husband shortly before her death. The prosecution argued that the statements of family members and the audio recording together established a pattern of cruelty and harassment.

Arguments Before the Court

Counsel appearing for the accused mother-in-law argued that the audio conversation did not contain any allegation of dowry demand against her and mainly referred to a dispute between the deceased and her husband over social media chats. It was also argued that the applicant was not present at the house during the incident in question and that the investigation had already been completed.

The State opposed the bail plea, contending that witness statements consistently pointed toward dowry-related harassment by the accused persons, including the mother-in-law. The prosecution also argued that releasing the accused at this stage could affect witness testimony during trial.

Court’s Observations

Justice Dr. Swarana Kanta Sharma noted that the deceased had died within eight months of marriage and that the allegations could not be viewed in isolation. The Court referred to statements made by the deceased’s parents and relatives, who alleged that she had repeatedly spoken about harassment linked to an alleged demand for ₹3 lakh.

The Court observed that the material collected during the investigation prima facie showed that the deceased had allegedly suffered both physical and mental harassment.

“The seriousness of the allegations is further aggravated by the fact that the marriage was only about eight months old at the time of the incident,” the Court observed.

The Court also relied upon a recent Supreme Court judgment stressing that courts must exercise greater caution while considering bail in alleged dowry death cases involving young brides.

Decision

Refusing bail, the High Court said the forensic report regarding the exact cause of death was still awaited and key witnesses had not yet been examined before the trial court. The Court held that there remained a possibility of interference with evidence or influence over witnesses if the applicant was released at this stage.

Accordingly, the bail application was dismissed. However, the Court granted liberty to the applicant to file a fresh bail plea after the complainant’s examination before the trial court.
