Accused Granted Anticipatory Bail by Delhi High Court in Metal Bangle Recovery Case

The Delhi High Court, on July 25, 2025, granted anticipatory bail to Pawan Kumar Singh, who was accused in FIR No. 491/2025 registered at Police Station S.P. Badli. The case involved alleged offences under Sections 110, 115(2), 126(2), and 3(5) of the Bharatiya Nyaya Sanhita (BNS).

Court Proceedings and Arguments

The anticipatory bail application, listed as Bail Appln. 2738/2025 along with CRL.M.A. 21355/2025, was heard by Justice Girish Kathpalia.

The petitioner was represented by Advocate Mr. Surender Yadav, while the State was represented by Mr. Nawal Kishore Jha, Additional Public Prosecutor, and the Investigating Officer, SI Amit Sehrawat.

The defense argued that the FIR was questionable in its legitimacy since a Kalandra under Section 126/170 of BNSS had already been registered before the FIR for the same incident. The defense also emphasized that the petitioner could not participate in the investigation due to his ongoing examinations.

Additionally, it was brought to the court’s attention that the co-accused in the same matter had already been granted bail. This further strengthened the petitioner’s case for anticipatory relief.

"It is argued that for the same incident, FIR No.491/2025 was registered after registration of Kalandra under Section 126/170 BNSS, therefore, the genuineness of the FIR is suspect," submitted the counsel for the accused.

On behalf of the State, the Additional Public Prosecutor accepted the notice and clearly stated that the State had no serious objection to granting anticipatory bail. However, it was emphasized that the petitioner must cooperate with the investigation, especially in aiding the recovery of the kada (metal bangle) allegedly involved in the case.

"The State has no serious objection to grant of anticipatory bail provided the accused/applicant joins investigation and helps in recovery of kada," stated the Additional Public Prosecutor.

After hearing both sides and considering that the co-accused were already out on bail, and the State did not oppose the bail strongly, the High Court granted anticipatory bail to Pawan Kumar Singh. The bail is subject to the accused furnishing a personal bond of ₹10,000 with one surety of the same amount.

“In view of no objection from State, the application is allowed… Pending application stands disposed of,” held Justice Girish Kathpalia.

The court directed that the bail would be effective in the event of the applicant’s arrest, and required him to cooperate fully with the investigating authorities.
