In a significant order, the Allahabad High Court granted bail to Babloo Yadav alias Billa while also raising concerns over lapses in police and prosecution coordination during the case proceedings.
Background of the Case
The bail application was filed in connection with Case Crime No. 401 of 2025 registered at Etmaddaula Police Station in Agra under provisions of the Bharatiya Nyaya Sanhita (BNS).
The applicant argued that his name did not appear in the original FIR and that he was later implicated based on recovery of a small amount of cash, a country-made pistol, and scrap material. His counsel maintained that there was no strong evidence linking him to the alleged offence and that he had been in custody since January 2, 2026.
During earlier hearings, the Court had expressed displeasure over the failure of the investigating officer to provide timely instructions to the government counsel despite receiving notice.
The compliance affidavit later revealed that the officer concerned was found negligent and subsequently suspended, with an inquiry initiated.
The bench also noted systemic issues, including lack of staff and delays in digitizing bail applications. It observed,
“The State Government should increase the strength of staff… so that required instructions can be obtained expeditiously.”
Further, the Court suggested engaging young law graduates as research associates to improve efficiency in prosecution offices.
The applicant’s counsel emphasized absence of incriminating material and assured cooperation in trial proceedings.
On the other hand, the State opposed the bail plea but did not dispute key factual aspects raised by the defence.
After considering the nature of allegations, available evidence, and broader factors like overcrowded prisons and pendency of cases, the Court held that the applicant was entitled to bail without commenting on the merits of the case.
The Court ordered Babloo Yadav’s release on furnishing a personal bond and two sureties, subject to conditions including cooperation in trial, non-interference with evidence, and abstaining from criminal activity.
