The Bombay High Court on Monday dismissed a Public Interest Litigation questioning the grant of Z+ security to Mohan Bhagwat, observing that the plea lacked genuine public interest and appeared motivated.
Background of the Case
The petition, filed by Lalan Kishor Singh, sought directions to recover security expenses from the Rashtriya Swayamsevak Sangh and its chief. It also relied on the Supreme Court’s ruling in Union of India Vs. Bikash Saha, arguing that high-level security must be based on a credible threat and should not burden public funds unnecessarily.
A bench led by Chief Justice Shree Chandrashekhar noted that the petitioner failed to disclose basic personal details or the source of information. The court found that the plea was based largely on a newspaper report without proper research.
“The petitioner does not disclose the source of information… and seems to have rushed to the Court,” the bench observed. It further stated that the petition did not demonstrate any real public interest.
Terming the PIL an “abuse of the process of law,” the court dismissed it outright. “Quite apparently this Public Interest Litigation is a motivated petition,” the bench said, bringing the matter to a close.
