The Delhi High Court refused to grant bail to a man accused of kidnapping and sexually assaulting a 14-year-old girl, observing that the allegations were grave and supported by trial testimony. The court said it was not a fit case to release the accused at this stage.
The order was passed by Justice Girish Kathpalia while hearing a regular bail plea filed by Amit alias “Point”, who has been in judicial custody since December 2024.
The bail application came up before the court in connection with a case registered at Narela Industrial Area police station. The accused is facing charges under the Bharatiya Nyaya Sanhita along with provisions of the Protection of Children from Sexual Offences (POCSO) Act. After hearing both sides, the court declined to grant relief.

According to the prosecution, the case began with a missing complaint filed by the girl’s father, who suspected that his minor daughter had been enticed away. During the investigation, the girl was traced and later gave a detailed statement to the police.
The prosecution claims that the accused had repeatedly stalked and frightened the girl over a period of time. It was alleged that he eventually took her to his friend’s office, detained her overnight, sexually assaulted her, and threatened her.
Based on these allegations, the police registered an FIR and arrested the accused. He has remained in custody since then, while the trial has moved forward.

Appearing for the accused, counsel argued that there were material contradictions in the girl’s statements recorded at different stages of the investigation. It was submitted that the accused had been falsely implicated and that continued incarceration was unjustified, especially since the trial was still ongoing.
The defence also pointed out that the accused had already spent over a month in jail and sought bail on the ground of prolonged custody.
The State, however, opposed the plea strongly. The Additional Public Prosecutor, assisted by the investigating officer, argued that the offence was serious in nature and involved a minor. The prosecution told the court that the key witnesses, including the prosecutrix, had supported the case during trial.
Justice Girish Kathpalia noted that the court had examined the testimony of the prosecutrix, who had already been examined as PW-1 during the trial.

The judge observed that the allegations involved the kidnapping and rape of a 14-year-old child and that the manner described in the testimony could not be ignored at the bail stage.
“Keeping in mind the severity of the offence, especially the manner in which the 14-year-old girl was kidnapped and raped, I do not find it a fit case to release the accused on bail at this stage,” the court observed.
The court also took note of the fact that public witnesses had supported the prosecution’s version.
In view of the seriousness of the allegations and the evidence already on record, the Delhi High Court dismissed the bail application along with the connected plea. The court clarified that nothing stated in the order would affect the merits of the ongoing trial.
