The Delhi High Court has rescheduled the Shahdara Bar Association elections to May 24, which were originally set for May 9.
A full bench comprising Justice Prathiba M Singh, Justice Navin Chawla, and Justice C Hari Shankar passed the order. The decision followed a report by Justice Talwant Singh (Retd.), Chairperson of the Shahdara Bar Association Election Committee, who highlighted difficulties in conducting the elections as planned.
Justice Talwant Singh's report, submitted to the Registrar General, outlined two major issues:
- EVM Availability: The Electronic Voting Machines (EVMs) required for the elections were initially scheduled for use by the Saket Bar Association on May 9. However, Delhi University, which is providing the EVMs, confirmed availability for May 24 instead.
- Election Expenses: The estimated cost for conducting the elections was around ₹20-25 lakh. The Chairperson requested each of the 34 contesting candidates to contribute ₹65,000 to the Election Committee's bank account to cover these expenses.
After reviewing the report and listening to the parties, the Court accepted the Chairperson's recommendations and ordered:
- Election Date Change: The polls are now set for May 24.
- Cost Contribution: All candidates, including those running for the post of treasurer, must deposit the specified amount by May 13. Failure to do so will disqualify them from contesting.
- EVM Management: The Saket Bar Association must release the EVMs immediately after their election counting to ensure they are available for the Shahdara Bar Association election.
- Security Measures: Previous instructions on police deployment, CCTV installation, and vote counting will remain in effect.
The Court emphasized the importance of maintaining order during the elections. It directed the Delhi Police to take strict action against anyone—whether lawyer or non-lawyer—causing any disturbance. The election area will be monitored via CCTV, with one feed provided to the DCP for security purposes.
On counting day, only the contesting candidates and their authorized representatives will be allowed inside the Karkardooma Courts premises. All others must remain outside.
