Karnataka HC Quashes FIR, Says Family Disputes Should Not Be Criminalised Without Evidence

The High Court of Karnataka has set aside criminal proceedings against a woman’s in-laws, holding that general and unclear allegations of dowry harassment cannot justify a full criminal trial.

Background of the Case

The case arose from a complaint filed by a woman against her husband and his family under Section 498A IPC (cruelty) and provisions of the Dowry Prohibition Act. The marriage took place in April 2018, but disputes surfaced within six months.

The complainant alleged that her husband, along with his parents and sister, demanded dowry and subjected her to mental and physical harassment. Based on her complaint, the police registered a case in 2018 and later filed a charge sheet in 2021.

The petitioners before the Court were the mother-in-law, father-in-law, and sister-in-law, who sought quashing of the proceedings.

Justice M. Nagaprasanna closely examined the complaint and the charge sheet. The Court noted that the allegations were largely “general and omnibus,” lacking specific details such as dates, incidents, or individual roles.

The Court observed,

A common place domestic discord… has been elevated to the pedestal of criminality.”

It further pointed out that many allegations related to pre-marital discussions on expenses and could not automatically be treated as unlawful dowry demands.

Referring to precedents of the Supreme Court, the judge emphasized that vague accusations without concrete material cannot meet the legal threshold required to prosecute family members under Section 498A IPC.

Allowing the petition, the Court held that continuing criminal proceedings against the in-laws would amount to an abuse of the legal process.

The Court ordered that all proceedings in C.C. No. 23089/2021 pending before the Bengaluru magistrate court stand quashed against the petitioners (accused 2 to 4).
