The Kerala High Court on Wednesday, 11th June, granted bail to six juveniles who were allegedly involved in the murder of 15-year-old Shahabas, a class 10 student from Kozhikode. The bail order was issued by Justice Bechu Kurian Thomas.
The Court is yet to release the detailed order in the matter.
The case revolves around the tragic death of Shahabas, who reportedly died after being attacked by his fellow tuition mates. Earlier, the same Court had rejected the bail applications submitted by the juveniles. However, in the present bail hearing, the Court allowed the applications.
The juveniles have been charged under various provisions of the Bharatiya Nyaya Sanhita (BNS), including:
- Section 103(1) – Murder
- Section 126(2) – Wrongful Restraint
- Section 189 – Unlawful Assembly
- Section 191(2) and 191(3) – Rioting
- Section 118(2) – Voluntarily Causing Hurt or Grievous Hurt
- Section 190 – Related Offences
While granting bail, the Court made an important observation regarding the applicability of the Juvenile Justice Act.
"The Juvenile Justice Act does not allow the continued stay of the juveniles in the observation home," the Court noted.
