The Madurai Bench of the Madras High Court has held that a candidate who did not upload the required educational qualification certificates while submitting his online application for a Tamil Nadu Public Service Commission (TNPSC) recruitment cannot later cure the defect during certificate verification, even if he was otherwise eligible for the post. The Division Bench ruled that recruitment authorities must strictly follow the conditions of the recruitment notification to ensure fairness to all applicants.

Background of the Case

The case concerned M. Senthilkumar, an ex-serviceman who applied under the ex-servicemen category for Group IIA posts pursuant to TNPSC Notification No. 03/2022. The notification required candidates to possess Higher Secondary (+2) or its equivalent along with a bachelor's degree.

Senthilkumar cleared both the preliminary and main examinations and was called for certificate verification. During verification, TNPSC found that he had uploaded his 10th standard mark sheet, Foundation Course certificate and bachelor's degree certificate, but had not uploaded his ITI certificate or the Army-issued graduation certificate, which could have established his eligibility under the applicable Government Orders. Instead, he relied on the Foundation Course certificate, which was no longer recognised as equivalent to the Higher Secondary qualification.

A Single Judge of the High Court had earlier directed TNPSC to consider his candidature, leading the Commission to file a writ appeal.

Court's Observations

The Division Bench of Justice G.R. Swaminathan and Justice S. Srimathy acknowledged that the candidate was otherwise eligible under the relevant Government Orders because of his ITI qualification and the Army-issued graduation certificate. However, the court held that eligibility alone could not override the mandatory requirement of uploading the relevant documents with the online application.

The Bench observed,

"The issue of eligibility is irrelevant in this case. The question is whether the required credentials were uploaded along with the application. When the answer is in the negative, the unfortunate consequences will have to follow."

The court also rejected the contention that the omission could be corrected during certificate verification, noting that the recruitment notification clearly stated that no modification would be permitted after submission of the application. Allowing such corrections would prejudice other candidates who had complied with the rules and undermine the integrity of the recruitment process.

At the same time, the Bench expressed concern over the rigidity of digital recruitment systems.

The judges observed,

"The purpose of digitization is to facilitate and expedite. It cannot turn out to be a trap."

They emphasised that online recruitment systems should be designed to help candidates avoid common mistakes instead of mechanically excluding them.

Court Suggests Systemic Improvements

While ruling in favour of TNPSC, the High Court advised the Commission to continue providing an application correction window in future recruitment notifications. It also recommended making the online application process more user-friendly by clearly indicating recognised equivalent qualifications and anticipating common mistakes that candidates may make while filling forms.

Decision

Allowing TNPSC's writ appeal, the Madras High Court set aside the Single Judge's order. The court held that although the candidate was otherwise eligible, his omission to upload the documents establishing that eligibility at the application stage could not be rectified during certificate verification.

No costs were awarded.
