The Madras High Court on Wednesday (8 July) granted anticipatory bail to DMK MLA and former Tamil Nadu Minister V. Senthil Balaji and his brother R.V. Ashok Kumar in a case involving allegations of a ₹35 crore offer made to influence the vote of a Tamilaga Vettri Kazhagam (TVK) MLA. The Court directed both petitioners to cooperate with the investigation and appear before the investigating officer every day until further orders.

Background of the Case

The case originated from a complaint by a TVK legislator, who alleged that he received a phone call offering ₹35 crore to vote in favour of a proposed resolution in the Assembly. The complaint also alleged that threats were issued when he did not agree to act as requested.

Following the investigation, police claimed the caller had acted at the instance of Senthil Balaji and Ashok Kumar. Three persons were arrested earlier in connection with the case.

During the hearing, Senior Advocate N.R. Elango argued that the complaint was lodged two days after the alleged phone call and that the prosecution relied only on call detail records without any audio recording of the conversation.

Justice G.K. Ilanthiraiyan also questioned the prosecution's case during the hearing, observing, “As per the FIR, there's nothing,” while seeking clarification on the role attributed to Balaji.

The State opposed the plea, submitting that the investigation had revealed material indicating an alleged conspiracy, including hotel room bookings and other evidence that was still being examined.

After considering the submissions of both sides, the High Court granted anticipatory bail to Senthil Balaji and Ashok Kumar, subject to conditions.

The Court directed them to appear before the investigating officer daily until further orders and to fully cooperate with the ongoing investigation.
