The Madhya Pradesh High Court has underlined that the security of judicial officers cannot be ensured only through police protection and has asked the State Government to present a concrete plan for providing proper government housing to judges serving in the district judiciary. The court said secure residential infrastructure is essential for maintaining the independence, privacy, and safety of judicial officers.
Background of the Case
The matter is being heard in a suo motu public interest proceeding initiated after an incident at Mandsaur raised concerns about the safety of judicial officers. Earlier, on July 1, 2026, the High Court had directed the Director General of Police and the Additional Chief Secretary (Home) to place their responses on record regarding measures taken for judges' security. The affidavits have now been filed before the court.
Court's Observations
The Division Bench observed that district judges and magistrates regularly deal with criminal cases, family disputes, civil litigation, and matters involving elected representatives, making them more exposed to litigants and accused persons. It stressed that protecting judicial officers is the State's primary responsibility to ensure fair, transparent, and independent administration of justice.
The Bench further noted,
“Ensuring their security is the prime duty of State so as to get fair, transparent and independent adjudication of disputes.”
The court also highlighted that many judicial officers continue to live in rented accommodation because official residences are unavailable. According to the Bench, this affects their privacy and makes effective security arrangements difficult. It observed that adequate government housing would significantly address these concerns.
Court's Decision
The High Court directed the Additional Chief Secretary (Home) to file a detailed affidavit outlining the State Government's proposed plan for developing housing and infrastructure for district judges and magistrates.
It also permitted the Judges' Association to place additional suggestions before the court.
The matter has been listed for further hearing in the week commencing August 25, 2026.
