The Madurai Bench of the Madras High Court has directed that private educational institutions and private employers in Tamil Nadu cannot mandatorily collect caste details. The order was passed by a Division Bench of Justice C.V. Karthikeyan and Justice R. Sakthivel on August 31, 2026, while disposing of a writ petition filed by N. Vikraman.
The petitioner sought directions to prevent private educational institutions and private employers from mandatorily collecting caste or community details in application forms, except where specifically required under statutory provisions. He also sought regulatory safeguards against discrimination in private institutions.
The petition raised concerns about the compulsory disclosure of caste and community information in educational and employment settings. The petitioner submitted that candidates could face discrimination or adverse action if they did not provide their caste details.
The Court also referred to an earlier ruling concerning caste disclosure in Transfer Certificates. In that case, the Division Bench observed that a blanket direction prohibiting caste disclosure in all Transfer Certificates could not be issued because some individuals might wish to disclose their caste. However, those who did not wish to disclose it need not be compelled to do so, in view of the Tamil Nadu Government Order dated July 31, 2000.
The earlier ruling discussed Tamil Nadu Government Order G.O.Ms. No. 205, dated July 31, 2000. The order permits individuals who do not wish to disclose their caste or religion in school certificates to leave the relevant columns blank or mention “No Caste” and “No Religion.” It also states that such details need not be insisted upon when parents do not wish, or are unable, to disclose them.
In the present case, the Bench issued a specific direction concerning mandatory caste-detail collection by private educational institutions and private employers in Tamil Nadu.
The Court stated:
“no private education institution or private employer within Tamil Nadu can mandatorily collect caste details.”
The Bench declined to issue any further directions. Accordingly, the writ petition was disposed of, with no order as to costs.
