Rajasthan HC Halts B.Sc. Nursing Counseling 2025-26 Until Pending NOCs Are Resolved

The Rajasthan High Court at Jodhpur has ordered a stay on the counseling process for the B.Sc. Nursing course for the academic session 2025-26 until further orders, citing the need to resolve pending No Objection Certificates (NOCs) before proceeding.

The Division Bench comprising Hon'ble Dr. Justice Pushpendra Singh Bhati and Hon'ble Mr. Justice Bipin Gupta was hearing a special appeal writ filed by the Rajasthan University of Health and Sciences (RUHS), Jaipur. The petition named the State of Rajasthan, the Rajasthan Nursing Council, the Private Physiotherapy, Nursing and Para Medical Institutions Society, and Deepshikha Kala Sansthan as respondents.

During the hearing, Mr. Vinay Kothari, counsel for RUHS, argued that continuing with the counseling without finalizing the NOCs could lead to discrepancies and irregularities in the admission process. He urged the court to halt the proceedings until the matter of NOCs was resolved.

Supporting this stance, Additional Advocate General Mr. Narendra Singh Rajpurohit, representing the State, stated that official instructions were also in favor of allowing counseling only after the NOC issue was addressed. The court observed that this joint proposition by RUHS and the State appeared reasonable.

"The counseling for the B.Sc. Nursing Course for the academic year 2025-26 shall remain stayed until further orders," the court stated, adding that any party could apply for continuation once the NOCs were cleared.

The Bench noted that while it would ordinarily avoid halting an entire counseling process due to public interest concerns, the unique circumstances of this case - particularly the risk of creating conflicting rights and deviations in nursing courses - necessitated such a step.

The judges directed the State to address the NOCs expeditiously, preferably within two weeks. Meanwhile, the appellant has been instructed to rectify certain procedural defects in the case. The matter is scheduled to be listed again after two weeks for further hearing.
