The Rajasthan High Court has refused to grant bail to several MBBS graduates accused of allegedly using forged Foreign Medical Graduate Examination (FMGE) clearance certificates to secure internships in hospitals. The Court observed that the allegations involved a serious attempt to enter the medical profession through fraudulent means, making the case unsuitable for bail at this stage.
Background of the Case
The connected bail applications arose from FIR No. 08/2026 registered by the Special Police Station, ATS & SOG, Jaipur, under provisions relating to cheating, forgery, criminal conspiracy and the Information Technology Act. According to the prosecution, the petitioners had obtained MBBS degrees from countries including Kazakhstan and Georgia but had not cleared the mandatory FMGE, which is required before foreign medical graduates can undergo internship and later seek registration with the Rajasthan Medical Council.
The petitioners argued that although some had failed the FMGE, none had ever become registered medical practitioners. Their counsel also submitted that several candidates withdrew from internships or did not use the certificates after learning they were allegedly fake. They further pointed out that the petitioners had no previous criminal record and sought their release on bail.
Court's Observations
The State opposed the applications, contending that the accused allegedly obtained forged FMGE clearance certificates through an organised network after repeatedly failing the examination. According to the prosecution, these certificates were allegedly created by replacing the details of successful candidates with those of the petitioners and were then used to obtain internship placements. The investigation is continuing, with 86 arrests made and several more persons still under investigation.
After examining the material on record, Justice Ravi Chirania noted that while the petitioners' MBBS degrees were not disputed, it was also undisputed that they had not cleared the FMGE and had allegedly used certificates that did not belong to them.
"The admitted act of using fake certificates of FMGE clearly shows that despite having the professional degrees, they did the above mentioned serious act, which cannot be taken lightly in the given facts and circumstances," the Court observed.
The Court also rejected the contention regarding delay in filing the charge-sheet, recording that the charge-sheet had been filed within the prescribed period, followed by a supplementary charge-sheet.
Decision
Considering the seriousness of the allegations and the ongoing investigation, the Rajasthan High Court held that it was not inclined to grant bail to the petitioners at this stage. Accordingly, all the connected bail applications were dismissed.
