What is Apprenticeship Deed?
An Apprenticeship Deed is a written contract under which an employer agrees to impart practical training in a designated trade to an apprentice, and the apprentice agrees to learn and serve the employer for the agreed training period. In India, this deed is primarily governed by the Apprentices Act, 1961 and the Apprenticeship Rules, 1992, with general contractual principles drawn from the Indian Contract Act, 1872 (Section 10).
Under Section 4 of the Apprentices Act, 1961, every apprenticeship contract must be in writing, signed by both parties, and registered with the Regional Apprenticeship Adviser or the State Apprenticeship Adviser within three months from the date of execution. Without registration, the deed has no statutory effect under the Act.
If the apprentice is a minor (below 18 years), the deed must be signed by the apprentice's guardian as required under Section 4(2). The employer must be a "designated establishment" or one approved under the Act. The deed defines the trade, training duration, stipend, working hours, leave, and termination terms. It is legally enforceable and forms valid evidence in disputes before Labour Courts and civil courts.
