What is Case File & Witness Applications?
Case File and Witness Applications are two distinct but related procedural applications filed in the course of a civil trial in India.
A Case File Inspection Application is a written request submitted to the court seeking permission to inspect the records, exhibits, and proceedings of a particular suit. It is filed by a party, an advocate, or sometimes a third party with court permission, under the general procedural rules framed under Section 122 of the Code of Civil Procedure, 1908 and the High Court's local rules. Inspection allows the applicant to verify documents, prepare cross-examination, or obtain certified copies under the Right to Information Act, 2005 read with court fee rules.
A List of Witnesses Application is filed under Order XVI Rule 1 of the Code of Civil Procedure, 1908, which requires every party to present a list of witnesses they propose to examine in support of their case within fifteen days from the date of framing of issues. Under Order XVI Rule 1A, a party may also produce a witness on the date of hearing without requiring summons.
Both applications form part of the court record and are admissible under the Bharatiya Sakshya Adhiniyam, 2023. Failure to file the witness list on time may, in certain cases, lead to the court refusing leave to examine that witness.
When This Format Required?
Pre-trial preparation — to inspect the original case file, exhibits, and prior orders before framing issues or preparing cross-examination strategy.
After framing of issues — to file the list of witnesses within fifteen days as mandated under Order XVI Rule 1 CPC; failure may bar examination of that witness later.
Securing attendance of witnesses — to obtain court summons to compel witnesses to appear and produce documents under Order XVI Rules 6 and 7 CPC.
Obtaining certified copies — for use in appeals, revisions, parallel proceedings, or for filing complaints based on the suit record.
