Misbah Qaiser, a Bachelor of Architecture student at Aligarh Muslim University (AMU), has approached the Allahabad High Court to contest an FIR filed against him. The FIR accuses him of rioting, wrongful restraint, and other charges related to alleged indiscipline during protests advocating for the reinstatement of student union elections.
The university administration alleges that Qaiser delivered speeches that incited fellow students, leading to the obstruction of the Vice Chancellor's vehicle and attempts to cause damage, with an alleged intent to carry out a deadly attack.
In his criminal writ petition, Qaiser asserts that on the day in question, a group of 100-125 students gathered to discuss concerns about attendance and upcoming examinations, without any unlawful intentions. He maintains that he did not deliver any speech that would have provoked students to act improperly.
Represented by Advocates Ali Bin Saif and Kaif Hasan, Qaiser argues that the FIR is an attempt to undermine the legitimate concerns of students regarding exams and attendance. The petition states, "On one hand, the university has suspended the petitioner and other named students, and on the other hand, it has lodged a First Information Report against them, which clearly shows that the present FIR is a clear abuse of the process of law."

Following the incident, the university suspended Qaiser, barred him from entering the campus, and ordered him to vacate his hostel accommodation.
The Allahabad High Court is scheduled to hear the case on February 11.
