The Delhi High Court has refused to grant bail to Gaurav Jaiswal in a case arising from allegations that he established a sexual relationship with a woman on the assurance of marriage and later allegedly threatened her using obscene photographs. Justice Girish Kathpalia passed the order on September 22, 2026, observing that the circumstances of the case did not make it appropriate to release the applicant on bail.
Background
The FIR was registered at Police Station Karol Bagh on September 22, 2025, following the complaint of the woman, who stated that she met Jaiswal through a matrimonial website in October 2024. According to the complaint recorded in the High Court order, he agreed to marry her after learning about her previous divorce. They began meeting to know each other before marriage, and on December 15, 2024, he allegedly took her from Humayun Tomb to Hotel Anand in Karol Bagh. She alleged that although she initially refused sexual relations before marriage, he assured her that they would spend their lives together, following which the relationship took place.
The complaint further alleged that on December 22, 2024, Jaiswal met her at Birla Mandir and took her to Hotel Silver Palace in Paharganj, where another alleged sexual incident occurred on the assurance of marriage. She stated that such relations allegedly continued while he kept postponing the marriage on different grounds. The woman also alleged that he asked her to agree to a threesome, which she refused. On August 3, 2025, she alleged that he showed her obscene photographs and threatened to circulate them, after which she accompanied him to Hotel Ratiram Palace, where another alleged sexual incident took place.
During the investigation, police allegedly found nine different profiles on the matrimonial website, created using different names, particulars, mobile numbers and email IDs. One of the profiles allegedly presented the person as a woman named “Sweta Sharma”. The order records that a witness from the matrimonial website, examined as PW-5 before the trial court, had proved that the different profiles were created by Jaiswal. The prosecution also relied on an audio recording allegedly containing his admission about taking objectionable photographs of the woman and cheating other women in a similar manner; the recording was later placed before the trial court for forensic examination.
During investigation, police reportedly found nine different profiles on the matrimonial website, created using different names, particulars, mobile numbers and email IDs. One of the profiles allegedly presented the person as a woman named “Sweta Sharma”.
The High Court noted that a witness from the matrimonial website had already testified before the trial court that the different profiles were created by Jaiswal.
The Court observed:
"As mentioned above, those profiles are of different ranges of age, different ranges of qualification and different ranges of occupation/income, which prima facie lends credence to the argument of learned ASC that the accused/applicant is a predator of innocent girls."
The Court also considered an audio recording allegedly containing Jaiswal's admission regarding taking objectionable photographs of the prosecutrix and cheating other women in a similar manner. The recording had been handed to the investigating officer but was not initially made part of the chargesheet or sent for forensic examination. The State subsequently moved the trial court for forensic analysis after a change of investigating officer.
After considering the circumstances, Justice Girish Kathpalia declined to grant bail to Jaiswal.
"Considering the above circumstances, I do not find it a fit case to grant bail. The bail application is dismissed."
The Court directed that a copy of the order be sent to the concerned Jail Superintendent. It also clarified that its observations would not prejudice either side and that the trial court would independently assess the evidence at the stage of final arguments.
