The Delhi High Court has granted four weeks’ interim bail on medical grounds to Lovkesh Bajaj, noting his recent major abdominal surgery and the need for careful medical management during recovery. The order was passed by Justice Sachin Datta on September 21, 2026.
Background
Bajaj had approached the High Court under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, seeking interim bail for four weeks in connection with FIR No. 197/2026, registered at Police Station Malviya Nagar under Sections 105, 326(g), 324(5), 125(a), 125(b) and 287 of the Bharatiya Nyaya Sanhita (BNS).
The Court had earlier sought a fresh medical report after the applicant’s counsel raised concerns regarding his open wound and whether it could be appropriately managed in jail.
The medical report from Central Jail No. 8/9, Tihar, recorded that Bajaj had undergone major abdominal surgery on August 31, 2026 and was discharged from RML Hospital on September 15. The report also noted that he required regular dressing and assistance during daily activities, with a risk of wound complications.
The Court observed:
“In the above circumstances, having regard to the nature of the surgery undergone by the applicant and the short period that has elapsed since his discharge from the hospital, without expressing any opinion on the merits of the present case, the Court is of the view that the applicant deserves to be released on interim bail on medical grounds, for a limited period, so as to enable him to recuperate and recover adequately.”
The High Court accordingly granted four weeks’ interim bail from the date of release, subject to a personal bond of ₹25,000 and one surety of the same amount. The applicant was directed to remain within Delhi, keep his mobile location services enabled, avoid contacting witnesses or the deceased’s family, and use the bail period only for medical treatment and recovery.
He must surrender after the bail period expires.
