The Delhi High Court has rejected the bail plea of a man accused in a case alleging that he killed his wife, chopped her body into pieces and dumped them in a septic tank. Justice Girish Kathpalia, while considering the seriousness of the circumstances recorded in the case, refused to grant him regular bail on August 20, 2026.

The Court was hearing Bail Application No. 3440/2026 arising out of FIR No. 519/2019 registered at Prem Nagar Police Station under Sections 302, 201 and 34 of the IPC. The Court also noted that although delay in trial can be a ground for bail, it cannot be considered in isolation.

Background of the Case

According to the prosecution case recorded in the order, the applicant allegedly went to the police station on February 22, 2019 and stated that he had killed his wife, cut her body into pieces and disposed of them in a septic tank.

The deceased's brother subsequently informed the police that she had been killed. Her body was recovered from the septic tank. The complaint also referred to allegations of harassment and dowry demands following the birth of three daughters.

The defence argued that there were contradictions in the statements of the deceased's mother and brother. It was also submitted that the applicant had not confessed at the police station and that the trial was progressing slowly.

Court's Observation

The State opposed bail, submitting that the trial was not unduly delayed. It also pointed to the alleged recovery of a blood-stained weapon, along with the deceased's clothes and jewellery, which had been examined forensically.

Justice Kathpalia observed:

“Of course, delay in trial is a ground for grant of bail. But that is not the only ground.”

The Court further noted that while considering bail, it could not ignore the circumstances surrounding the alleged killing and subsequent disposal of the body.

Decision

Considering the circumstances placed before it, the Delhi High Court held that the case was not fit for grant of bail.

The Court therefore dismissed the bail application and the accompanying application. A copy of the order was directed to be sent to the concerned Jail Superintendent for being conveyed to the applicant.
