Delhi HC Protects Abhishek Sharma's Personality Rights, Directs Removal of AI-Generated Posts

The Delhi High Court directed the removal of allegedly AI-generated and misleading online content misusing cricketer Abhishek Sharma's identity, issued summons to the defendants and proposed interim protection of his personality rights.

The Delhi High Court has directed the removal of several online posts and links allegedly misusing the identity of Indian cricketer Abhishek Sharma while hearing his lawsuit seeking protection of his personality rights. The Court also issued summons to the defendants accused of publishing AI-generated, misleading and unauthorised content using the cricketer's name and likeness.

Background of the Case

The suit was filed after Sharma alleged that multiple social media accounts and online platforms circulated AI-generated images, misleading captions and other content portraying him in a false and objectionable manner. He also complained that his identity was being used without permission on e-commerce platforms for commercial purposes.

During the hearing, Sharma's counsel informed the Court that several of the offending web links had already been removed after compliance with an earlier direction. However, some social media posts and commercial listings were still available online.

Counsel appearing for Meta submitted that only two remaining posts on its platforms were yet to be removed and assured the Court that necessary action would be taken. Amazon also informed the Court that it would remove the identified listings upon receiving a judicial order.

Justice Jyoti Singh observed that immediate protection was required against the continued unauthorised use of the cricketer's personality.

The Bench said,

"At this point in time, I will direct their takedown and I will injunct the defendants as we usually do."

The Court also examined the Facebook and Instagram posts placed on record along with the list of URLs identified in the suit. It directed that summons and notices be served on the defendants through their social media accounts, available addresses and all other legally permissible modes.

The Delhi High Court stated that it would pass an interim order directing the takedown of the identified offending links and restraining the unauthorised exploitation of Sharma's personality.

The matter has been listed for further hearing on November 17.
