The Delhi High Court on September 9, sought instructions from the National Investigation Agency (NIA) on whether Baramulla MP Sheikh Abdul Rashid, also known as Engineer Rashid, could be released on bail subject to strict conditions, including remaining in Delhi.

A bench of Justice Prathiba M Singh and Justice Vikas Mahajan was hearing Rashid’s plea challenging the rejection of his bail application in the case registered under the Unlawful Activities (Prevention) Act (UAPA).

During the hearing, the Court noted Rashid’s long period in custody and asked the NIA to consider whether restricting his movement to Delhi could address its concerns.

"The court is putting to you - the biggest threat from him is his physical presence in Kashmir because he has a lot of local influence. Suppose there is stringent condition that he will remain only in Delhi, what is your (NIA) response? That he will find a place of residence and remain only in Delhi," the bench said.

The NIA opposed bail, submitting that material on record raised serious allegations against Rashid. It also referred to concerns regarding his alleged attempt to influence a witness during an earlier period of bail.

The Court directed the NIA to obtain instructions on bail with stringent conditions and listed the matter for November 3.

The Delhi High Court did not decide the bail plea at this stage and sought the NIA’s response before the next hearing.
