Delhi High Court Orders Protection for Inter-Faith Couple Facing Threats from Family

The Delhi High Court has directed the State to provide continued protection to a 25-year-old Hindu woman and her Muslim partner, who have been in a relationship for over seven years and recently applied for marriage under the Special Marriage Act, 1954. The couple approached the court after facing strong opposition and alleged threats from the woman’s family, particularly her father, over their inter-faith relationship.

Justice Sanjeev Narula noted that Article 21 of the Constitution grants every adult the right to marry a person of their choice, free from fear, coercion, or unlawful restraint. The Court emphasised that parental preferences, however well-intentioned, cannot override an adult’s autonomy.

"The State’s role is not just to avoid harm but to create conditions where such rights can be safely exercised," the Court stated.

The court directed that the couple remain in a safe house until their marriage is solemnised, with periodic threat assessments by the DCP. Any act of intimidation, including from family members, must be promptly acted upon by the police.

The Court also addressed allegations by the woman that she was previously separated from her partner against her will and placed in a shelter home without access to her phone. The DCP has been ordered to record her statement on this matter and submit a detailed report, identifying any officers responsible if unlawful separation occurred.

A status report on the functioning of the Supreme Court-mandated helpline in the Shakti Vahini case has also been sought. The matter will be heard further on September 12, 2025.
