The Gujarat High Court on Thursday(2 April) came down heavily on the State Public Service Commission (GPSC), observing that the affidavit filed in the ongoing ‘Arthashastra’ question dispute was “nothing but contempt.” The court said its earlier directions had been clearly ignored.

Background of the Case

The matter arises from a recruitment examination conducted by GPSC, where a candidate missed qualifying by just one mark. She challenged the answer key, arguing that a question based on Kautilya’s Arthashastra was incorrectly framed.

Earlier, on March 20, the court had already expressed dissatisfaction with GPSC’s affidavit, calling it an “eyewash” for failing to clarify whether the source material a PDF version of the book was authentic. The commission was specifically asked to explain its policy for verifying such material.

When the fresh affidavit was presented, Justice Nirzar S. Desai found it inadequate and sharply questioned the conduct of GPSC officials.

“My order was very specific. What I have asked has not been answered. This is nothing but contempt,” the judge remarked orally.

The court went further, questioning whether the failure reflected incompetence or deliberate disregard.

“Does it reflect poor understanding… or a mindset that they are above the court?” the bench asked.

Senior advocate Megha Jani, appearing for the candidate, pointed out that even earlier directions had not been complied with despite repeated opportunities.

The court also rejected GPSC’s attempt to shift responsibility to subject experts. It observed,

“You just want to enjoy powers without any responsibility… Where is the provision that limits your role?”

At one point, the court criticized the commission’s functioning, saying,

“You just want to enjoy power, play with the future of candidates. But when it comes to responsibility, you raise your hands.”

GPSC’s counsel sought more time, but the court questioned the delay, noting sufficient opportunities had already been granted. The bench even considered issuing contempt notices against the Commission’s Chairman and Secretary.

Later, the matter was briefly deferred as the Government Pleader was unavailable. The court indicated it would hear the State before taking further steps on contempt.

The High Court listed the matter for April 7 at 11 AM, stating that it would decide further action after hearing the Government Pleader. It also indicated that GPSC officials may be called to appear if required.
