The Kerala High Court has granted regular bail to K. Shuhaib, the Founder and CEO of MS Solutions, who was booked for allegedly leaking State Board Class 10 Question Papers through his YouTube channel.
Earlier, the Court had refused to grant him anticipatory bail, stating that leaking exam papers amounts to cheating a section of students. Following this, Shuhaib surrendered on March 6 and has remained in custody since then.
Allegations Against Shuhaib
Shuhaib has been accused of leaking Second Term Examination 2023 and First & Second Terminal Examination 2024 question papers. The leaks reportedly happened through his YouTube channel, ‘MS Solutions,’ under the name ‘question prediction,’ well before the exams were conducted.

A complaint was filed alleging that the predicted questions exactly matched those in the actual exam papers. This has led to suspicions that Shuhaib somehow accessed the real question papers before the exams. The case is currently being investigated by the Crime Branch.
Shuhaib’s Defense
Shuhaib has denied any wrongdoing, claiming that the allegations are motivated by professional rivalry. He has argued that the case was filed to divert attention from existing complaints regarding question paper leaks linked to private tuition centers and the Education Minister’s office.
According to Shuhaib, he only predicted probable questions based on previous years’ exam patterns and did not engage in any illegal activities.

Court’s Observation and Decision
Justice P. V. Kunhikrishnan, while granting bail, noted that Shuhaib had already been questioned by the Investigating Officer (IO) during his custody. The Court emphasized that:
“Indefinite incarceration is not necessary in this case.”
After considering the arguments and circumstances, the Court granted regular bail to Shuhaib.
