Kerala High Court Directs Preservation of CCTV Footage in Alleged Fake NDPS Case

The Kerala High Court has ordered the preservation of CCTV footage at Cheranelloor Police Station after a 22-year-old mentally challenged individual filed a petition claiming that a fake case under the Narcotic Drugs and Psychotropic Substances (NDPS) Act was registered against him.

According to the petitioner, the case was a result of personal rivalry and had no legal basis. The Court has now directed authorities to retain the CCTV footage as crucial evidence in the case.

The petitioner, represented by his father, alleged that he was falsely implicated in a case under Section 20(b)(ii)(A) of the NDPS Act (offense involving a small quantity of cannabis). He claimed that:

  • His father received a call from Cheranelloor Police Station, asking him to bring his son.
  • After reaching the station, a fake case was allegedly registered against him.
  • The First Information Statement (FIS) falsely claimed that the Sub-Inspector (SI) brought him to the police station.
  • The CCTV footage from the police station would prove the actual sequence of events.

The case was presented before Justice V. G. Arun, who has scheduled the matter for further hearing on May 23.

The petition further alleged that the case was a result of political enmity between the petitioner's father and the relatives of Assistant Sub-Inspector (ASI) of Cheranelloor Police Station.

  • The ASI's cousins, Shameer and Illiyas, belonged to an opposing political party.
  • The rivalry intensified after the petitioner's father protested against Shameer’s wife, who was employed at Kalamassery Medical College.
  • The protest was based on allegations that she illegally changed a newborn’s birth certificate.
  • Following this, Shameer and Illiyas allegedly trespassed into the house of the petitioner's aunt and attacked his uncle.
  • A case was filed against them, but the ASI allegedly tried multiple times to settle the case out of court, which the petitioner's father refused.

The petitioner claims that, in retaliation, he was falsely implicated in the NDPS case as a pressure tactic against his father.

Given the seriousness of the allegations, the Court has emphasized the preservation of CCTV footage as essential evidence.

The petition is being handled by Advocates Meenakshy Parvathy, Nandagopan M. C., Arun T. S., and Sreeparvathi G. V. The case remains under judicial consideration, with further proceedings scheduled for May 23.
