The High Court of Orissa at Cuttack recently disposed of a writ petition filed by Shibani Dainaik, a teacher challenging her transfer order and seeking counting of her 35 years of service. The bench, presided over by Justice Biraja Prasanna Satapathy, directed the state authorities to decide on her representation within three months.
The petitioner had been transferred through an order dated April 30, 2025, issued by Opposite Party No. 3, and was relieved from her position on May 3, 2025. She sought to quash these orders and continue serving at her current place of posting-CHC Shirsa. Additionally, she requested the court to direct the authorities to count her 35 years of service.
Despite filing a detailed representation (Annexure-6) before the concerned opposite party, no action had been taken on her grievances. During the hearing, the petitioner’s counsel highlighted the inactivity and urged the court to intervene.
The state counsel did not raise any objection to issuing a direction for a time-bound decision. Taking note of the submissions and without commenting on the merits of the case, the court ordered:
“Opposite Party No. 3 to take a decision on the above noted petition in accordance with law, within a period of three (3) months from the date of receipt of this order and communicate the result of such exercise to the Petitioner.”
The writ petition was disposed of accordingly, offering relief to the petitioner while ensuring administrative fairness. The court’s directive emphasizes the importance of timely resolution of service matters affecting government employees.
