The Delhi High Court has denied bail to an accused in a case involving alleged sexual exploitation of a minor and circulation of objectionable content on social media, highlighting the seriousness of such offences.
Background of the Case
The case arises from FIR No. 179/2025 registered at Jyoti Nagar Police Station. The complainant alleged that the accused, known to her, had exploited her when she was a minor and continued to harass and blackmail her over several years.
It was further alleged that inappropriate photos and videos were recorded and later uploaded on fake social media accounts created in her name, leading to their circulation among acquaintances.

The accused was arrested in June 2025 after his anticipatory bail plea was rejected and has been in custody since then.
The defence argued that the accused had been falsely implicated and that the relationship was consensual. It also pointed to delay in filing the complaint and absence of recovered objectionable material.
The prosecution opposed bail, stating that the allegations were grave and supported by the complainant’s statement and technical evidence, including details of social media accounts allegedly operated by the accused.
Justice Swarana Kanta Sharma observed that the allegations involved not only sexual exploitation of a minor but also misuse of digital platforms to circulate objectionable material.

“The allegations… include recording and dissemination of inappropriate material,” the court noted.
It further found that evidence on record, including witness statements and technical data, prima facie linked the accused to the operation of fake accounts used to upload such content.
Rejecting the argument of parity with a co-accused already on bail, the court said the roles attributed to each were different.
The bench also highlighted the lasting impact of online circulation of such material, noting that once shared, it can spread widely and cause long-term harm to the victim’s dignity and privacy.
Taking into account the seriousness of the allegations, the evidence collected, and the stage of the proceedings, the court held that the case was not fit for grant of bail.
The bail application was accordingly dismissed, with the clarification that the observations made would not influence the trial.
