In a significant order dated 04.08.2025, the Punjab Court addressed the persistent issue of delayed medical reports, such as X-rays, NCCT, CT scans, and ultrasounds, which are critical for criminal investigations. The court highlighted how these delays not only hinder investigations but also violate the rights of victims and accused alike, leading to unfair trials.

The court noted that investigating officers often receive medical reports late, causing unnecessary delays in criminal cases. This negligence affects both victims, who are denied timely justice, and the accused, whose right to a speedy trial is compromised. The court emphasized that such delays could stem from either corruption or sheer negligence by doctors in government and other hospitals.

"This not only seriously prejudices the rights of the victim of crime but also amounts to denial of fair and speedy trial to the accused."

Assurances from Health and Police Departments

During the hearing, the Secretary of the Department of Health and Family Welfare, Punjab, assured the court that a meeting would be held with the Home Secretary and the Director General of Police (DGP) to create a mechanism for uploading medical reports onto a portal. This would ensure immediate access for investigating officers. Additionally, the Secretary pledged to instruct all Civil Surgeons in Punjab within three days to comply with existing orders.

The court also criticized the Punjab Police for their lack of supervision, particularly Senior Superintendents of Police (SSPs), who are legally obligated to ensure timely collection of medical reports. The case in question involved an ultrasound report for a complainant, Kiran, which was requested 43 days after the incident—a clear example of gross negligence.

Despite a circular (No. 14 of 2025) issued by the DGP Punjab to streamline the process, lower-ranking police officials failed to adhere to the directives. The court termed this as misconduct and negligence, stressing the need for immediate corrective action.

The State counsel assured the court that the Health Secretary, SSP Fazilka, and the Principal of Guru Gobind Singh Medical College, Faridkot, would take necessary measures to prevent such delays in the future. An action-taken report will be submitted via personal affidavits by these officers by the next hearing on 18.08.2025.

Meanwhile, the petitioner, Lakhwinder Singh @ Lakhu, was directed to cooperate with the investigation. If arrested, he would be granted interim bail under Section 438(2) Cr.P.C./482(2) of BNSS, 2023.
