In a recent development, the Supreme Court of India has allowed the withdrawal of a divorce plea filed under Article 142 of the Constitution. The case involves Rahul Basoya as the petitioner and State of Haryana & Anr. as the respondents.

Case Background

The case originated from a final judgment passed by the Punjab and Haryana High Court in CRM-M No. 27739/2021 dated November 21, 2024. The matter reached the apex court as Special Leave Petition (Criminal) No. 17618/2024.

The matter was heard on July 25, 2025, before a bench comprising:

During the hearing, the following important actions took place:

"Issue notice, returnable in two weeks."

The court formally issued a notice and scheduled the next proceedings in two weeks.

The petitioner’s counsel sought permission to withdraw IA No. 158047 of 2025, which was filed under Article 142 seeking a divorce decree.

“Learned counsel for the petitioner prays for withdrawal of IA No. 158047 of 2025 (application under Article 142 for grant of divorce). Prayer is accepted. The said interlocutory application stands dismissed as withdrawn.”

This means the plea for divorce has been officially retracted from court records.

The court also acknowledged the receipt of the mediation report, which was likely part of the reconciliation process between the parties.
